Medical Malpractice
Medical malpractice is the act in which a doctor, surgeon, or other licensed healthcare provider acts negligently, causing injury or death in a patient. Patients expect a timely diagnosis of a medical problem along with proper treatment. In some cases a delay in diagnosis may have serious consequences to the patient and may affect their quality of life.
Doctors and other medical staff are professionals and respected by the community. It is their duty to safely and correctly treat patients with the individual's best interest and health in mind.
Some types of medical malpractice may be:
• Delay in diagnosis
• Anesthesia error
• Improper consent before a medical procedure
• Surgical error
• Failure to diagnose a medical condition
• Improper treatment of an illness or disease
• Birth injury, including Cerebral Palsy and Brain Damage
• Prescription drug error
• Negligence
In the state of New York, medical malpractice victims have two and a half years to file a medical malpractice claim. Certain medical malpractice situations have different time frames.
